FULL FIVE YEAR WARRANTY

THE WARRANTY

For a period of five (5) years from the date of purchase, SP Technology Loudspeakers, Inc. (herein after “SP Technology”) warrants to the original Purchaser of each new SP Technology component that it is free from any substantial defects in materials and workmanship and that it will meet or exceed all advertised specifications for such component.

NOTIFICATION OF CLAIMS

The Purchaser must make a reasonable attempt to return any component claimed by the Purchaser to be in breach of warranty to the authorized service dealer from which it was originally purchased. If, for reasons beyond the control of the Purchaser it is not possible to return said component to the service dealer, then the Purchaser must notify SP Technology in writing at the address set forth below. Such notification shall be delivered to SP Technology within a reasonable length of time after discovery of the claimed defect and not later than thirty days after expiration of the warranty period. Within ten business days after receipt of the notification, SP Technology will request Purchaser to deliver the component to another authorized service agency for repair in the Purchaser’s area or will deliver to Purchaser written authorization to return the component to SP Technology for factory warranty service. If SP Technology (or its authorized agent’s) inspection reveals that there has been a breach of the warranty, SP Technology (or its agent) will initiate corrective repairs within thirty days after receipt of the component. All components must be shipped in original factory packaging, which if needed, may be obtained from SP Technology. All such repairs, including labor, parts and one way return to Purchaser shipping costs within the United States will be made at SP Technology’s expense. Purchaser must bear the expense of shipping the component to SP Technology including all taxes, duties and other customs due for foreign shipments as well as such costs as are incurred to return the component to a foreign country from the United States port of departure.

WARRANTY

THIS SP TECHNOLOGY WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE. If the repairs made by SP Technology or the authorized service agent are not satisfactory, Purchaser should immediately give written notification to SP Technology. If the defect or malfunction remains after a reasonable number of attempts by SP Technology to remedy such, the Purchaser shall then have the option to elect either a refund for or replacement without charge, of the SP Technology component. The refund shall be an amount equal to the actual purchase price, not including any interest, insurance, closing cost and other finance charge, minus reasonable depreciation on the component. If a refund is demanded, the Purchaser must make the defective or malfunctioning component available to SP Technology free and clear of all liens and other encumbrances. Should SP Technology fail to meet its obligation hereunder, Purchaser may sue SP Technology to secure its compliance with this warranty. ANY SUIT BY PURCHASER FOR BREACH OF THIS WARRANTY MUST BE FILED WITHIN SIX (6) YEARS OF THE DATE OF PURCHASE TO THE ORIGINAL PURCHASER.

WARRANTY VIOLATIONS

SP Technology SHALL HAVE NO RESPONSIBILITY IF THE COMPONENT HAS BEEN SUBJECT TO MISUSE, ACCIDENT, NEGLECT OR FAILURE TO COMPLY WITH NORMAL MAINTENANCE PROCEDURES OR IF THE SERIAL NUMBER HAS BEEN DEFACED, ALTERED OR REMOVED; NOR WILL SP Technology ACCEPT RESPONSIBILITY FOR OR RESULTING FROM IMPROPER ALTERATIONS OR UNAUTHORIZED PARTS OR REPAIRS. THIS WARRANTY DOES NOT COVER ANY DAMAGE TO DRIVERS (woofers, midranges tweeters, etc.) THAT IS A RESULT OF RMS POWER IN EXCESS OF THE AMOUNT SPECIFIED FOR THAT COMPONENT, FROM DISTORTION CAUSED BY AN AMPLIFIER THAT IS OPERATED IN EXCESS OF ITS PEAK POWER RATING (i.e., amplifier clipping) OR A DEFECTIVE OR MALFUNCTIONING AMPLIFIER. NEITHER DOES THE WARRANTY COVER ANY DAMAGE TO AMPLIFIERS OR OTHER COMPONENTS FROM OTHER MANUFACTURERS OR ANY OTHER CONSEQUENTIAL DAMAGES RESULTING FROM BREACH OF ANY WRITTEN OR IMPLIED WARRANTY.SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATIONS OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

MODIFICATIONS OF EQUIPMENT

SP Technology reserves the right to modify or change equipment in whole or part at any time prior to delivery thereof, in order to include therein electrical or mechanical improvements deemed appropriate by SP Technology, but without incurring any liability to modify or change any equipment previously delivered, or to supply new equipment in accordance with any earlier specification. We reserve the right to change the design of any product from time to time without notice and with no obligation to make corresponding changes in products previously manufactured.

WARRANTY ALTERATIONS

NO PERSON HAS THE AUTHORITY TO ENLARGE, AMEND OR MODIFY THIS WARRANTY. THE WARRANTY IS NOT EXTENDED BY THE LENGTH OF TIME WHICH THE PURCHASER IS DEPRIVED OF THE USE OF THE COMPONENT. REPAIRS AND REPLACEMENT PARTS PROVIDED PURSUANT TO THIS WARRANTY SHALL CARRY ONLY THE UNEXPIRED PORTION OF THIS WARRANTY.
